Purposes of the Mediator Opening Statement

It is important for the mediator to set the proper tone for the mediation. Following is a list of purposes the mediator can seek to accomplish during the opening statement.

2. Set the tone for the session __Positive __Relaxed __Cooperative __Enthusiastic __Open and candid __Mutual resect __Desired level of formality __Potential success of the mediation process __Mutual desire for resolution of the dispute

3. Establish credibility with the parties 4. Outline the agenda/game plan

5. Outline procedural considerations

6. Obtain a commitment from the parties to mediate in good faith

7. Establish rapport with the parties

8. Establish a pattern of agreement
