Claimant Opening Statement

As a general rule, the mediator will know little about the facts of the dispute. The opening statement provides each party with an excellent opportunity to educate the mediator, as well as the opposing party, of the key facts of the case and the basis of the dispute. Following is a checklist to assist in preparing an effective opening statement.

1. Content

__Claimant’s names, relationships, et. __Claimant’s relationship to respondent __Date, time, place of event complained of __Causes of action/theories of recovery __Claimant’s factual contentions __Liability __Damages __Relief sought and why __Undisputed facts __Disputed facts __Legal issues __Documents, photos or other evidence supporting the claim __Previous offers of settlement __By Claimant __By Respondent __Why previous negotiations/discussions have failed to achieve settlement

2. Supporting Materials __Visual aids or demonstrative evidence to be used __Documents, photos or other evidence supporting the claim
