Probate Mediation is "taking off." Nearly a dozen states have now formalized Probate mediation programs.  In response, Jim Melamed and Robert Benjamin, nationally prominent mediation instructors, have developed a top quality probate mediation training program.

Many of the characteristics of probate disputes make them especially amenable to mediation. These factors include multiple parties, continuing relations and numerous issues. Whether the issues are matters of estate planning, including family business succession, conservatorships and the like, or disputes following a death, including will contests and trust administration, mediation is an especially appropriate way for families to maintain control and consider various means of resolution in a safe and confidential environment. The option, litigation, is remarkably expensive, burdensome and risky.  Whenever possible, it is best for first take a crack at resolving the case voluntarily (and early) in mediation.

This course is offered over four intense days of exciting instruction beginning at 7:30 a.m. to 6:00 p.m. each day.  The instructors and participants will engage in demonstrations, videotape  presentations, lecture and discussion, role play exercises (with faculty feedback) and learn from extensive written materials specially prepared for this course.

  • Facilitating Agreement Exercises and Role Playing
  • Special Aspects of Mediation in the Trust, Estate and Guardianship (Conservatorship) context

CLE Credit

ACTEC will assist participants in qualifying for up to 40 hours of CLE credit in the participant's state.  Virtually all states recognize this course as acceptable for continuing legal education credit.

The full price for the Program is $1395 (with a $100 discount if the full fee is paid at least 30 days in advance of the Program).  The fee includes the course training, written materials, and continental breakfast each day of the course.
